Dem Urheberrecht zufolge können Werke nur dann Schutz genießen, wenn sie eigene geistige Schöpfungen ihres Urhebers darstellen und individuelle Form aufweisen. Urheber haben das alleinige Recht, ihre Werke in unterschiedlichster Weise zu nutzen. Will jemand anderes die Werke nutzen, muss dafür meistens eine Erlaubnis vorliegen.

Urheberrechtlich betrachtet, sind „Rezept als Beschreibung“ und „Rezept als Idee zur Speisenzubereitung“ zwei grundverschiedene Dinge: Das Erste ist die Form, das Zweite der Inhalt. Urheberrechtlich geschützt sein kann nur ein „Rezept als Beschreibung“, also die sprachliche Form.

Nicht die Idee zu einer bestimmten Speise kann geschützt sein, nur die Darstellung dieser Idee. Gleich wie originell oder hochwertig das Gericht ist, geschützt ist niemals die Zusammenstellung der Zutaten, sondern nur – wenn überhaupt – die Formulierung, mit der der Rezeptautor sein Gericht oder seine Kochanleitung beschrieben hat.

Die bloße Nennung von Zutaten oder Mengen von Zutaten ist unproblematisch. Da die Zutaten feste Bezeichnungen haben und in Rezepten üblicherweise auch so genannt werden (Salz ist Salz und nicht „ein hauptsächlich aus Natriumchlorid bestehendes Gewürz“) ist ihre Niederschrift keine individuelle Schöpfung. Das Kopieren von Zutaten und Mengenangaben ist daher zulässig.

Besteht das Rezept, das man kopieren möchte, nur aus ein paar Mengenangaben und wenigen Worten, mit denen die Zubereitung beschrieben wird, braucht man nicht lange nachdenken. Solche Rezepte sind nicht urheberrechtlich geschützt und dürfen beliebig kopiert und anderweitig genutzt werden.
Je größer aber der Anteil individueller Formulierungen wird, desto größer wird die Chance, dass die urheberrechtlich geforderte Schöpfungshöhe erreicht wird.

Ausschweifende, poetische Beschreibungen der Art, dass „sich sanft geschmolzene Butter in das gesiebte und makellos gehäufte Mehl in einem Strudel ergießen solle“, machen aus einer simplen Bedienungsanleitung schnell ein literarisches Werk. Dessen Autor oder Autorin darf dann für ihre Formulierungen dasselbe beanspruchen wie Nobelpreisträger Günter Grass für seine Romane: Urheberrechtsschutz bis 70 Jahre nach dem Tod.
Übernimmt man nicht die Geschichte, die ein besonders kreativer Rezepte-Schreiber über sein Gericht verfasst hat, sondern beschränkt sich auf die hierin enthaltene Nennung von Zutaten, Mengen und die mit eigenen Worten wiedergegebene Handlungsanweisungen, ist das erlaubt.

Es ist also kein Plagiat, wenn ich euch nicht verrate, woher das Lieblings Muffin Rezept meiner Tochter stammt!

Zutaten (12 Muffins):

55 g Mehl
1 TL Backpulver
1/3 TL Salz
120 g Zucker
120 g Butter, geschmolzen und abgekühlt
20 ml Espresso, abgekühlt
3 Eier, getrennt
100 g Schokolade, geschmolzen und abgekühlt

1. Den Backofen auf 220 Grad vorheizen.
2. Mehl, Backpulver und Salz in einer Schüssel mischen.
3. Flüssige Butter, Espresso und Zucker in einer zweiten Schüssel cremig rühren. Die Eigelbe einrühren.
4. Das Eiweiß steif schlagen.
5. Die Schokolade und die Mehlmischung zügig unter die Buttermischung rühren. Zuletzt den Eischnee unterheben.
6. Den Teig in die Förmchen füllen.
7. Die Muffins 10-15 Minuten backen. Der Teig soll aufgegangen sein, aber auf Fingerdruck noch leicht nachgeben.
8. Die Muffins aus dem Ofen nehmen. Kurz abkühlen lassen und servieren.
